Welcome to the online ordering website of "Hummus elite" (the "Restaurant"). This site allows customers to place online orders for delivery or pickup of menu items. Please read these Terms of Service and Privacy Policy carefully before using the site. By using the site, you agree to these terms.
1. Terms of Service
1.1 Operation of the Site
1.1.1. This site is operated and managed by "Hummus elite" (the "Restaurant"), which is solely responsible for the services provided through it.
1.1.2. The site allows customers to place orders through an online system and choose between delivery and pickup.
1.1.3. These Terms of Service also apply to the in-store kiosk at the Restaurant, if one exists.
1.2 User Obligations
1.2.1. Use of the site is conditioned on acceptance of these Terms of Service and Privacy Policy.
1.2.2. The Restaurant reserves the right to update these terms from time to time.
1.2.3. It is the user's responsibility to review the Terms of Service periodically for updates.
1.3 Purchase and Cancellation Terms 🔶
1.3.1. All transactions made through the site are final, except in cases of a discrepancy between the order placed and the items delivered, or a defect in a product.
1.3.2. An order that has already been paid for cannot be canceled once the item has entered preparation.
1.3.3. In the event of a malfunction or unavailability of a product, the Restaurant will contact the customer to update the order or offer an alternative.
1.3.4. Placing an order through the site constitutes the customer's confirmation of, and agreement to, all Terms of Service and policies, including this Privacy Policy, this cancellation policy, and stated delivery times.
1.3.5. Product photos on the site are for illustration purposes only; actual products may differ from the photos shown.
1.4 Delivery
1.4.1. Orders may be placed for delivery or pickup, depending on the options shown on the site.
1.4.2. Once an order is complete, the chosen delivery/pickup method cannot be changed.
1.4.3. Delivery times shown on the site are estimates and may change due to circumstances outside the Restaurant's control.
1.4.4. The Restaurant may request to see identification at the time of delivery.
1.5 Intellectual Property
1.5.1. All content on the site, including text, images, videos, logos, and other intellectual property, is owned by the Restaurant or used by the Restaurant with the permission of the rights holder, and is protected under applicable U.S. copyright and trademark law.
2. Privacy Policy
2.1 Types of Information Collected
2.1.1. When an order is placed, the Restaurant stores the customer's name, phone number, delivery address (for delivery orders), and prior order history.
2.1.2. An email address is optional and is stored only if provided by the customer.
2.1.3. Credit card data is not stored on the Restaurant's servers; it is processed directly by a PCI DSS-certified payment processor.
2.1.4. A customer may provide additional information, such as special requests (e.g., allergies or dietary preferences). This information is treated as sensitive and is retained only for purposes of fulfilling the order.
2.1.5. 🔶 Order cancellations and refunds are handled in accordance with the Restaurant's cancellation policy set out in Section 1.3 above, the FTC's Mail, Internet, or Telephone Order Merchandise Rule (16 C.F.R. Part 435), and the New Jersey Consumer Fraud Act, N.J.S.A. 56:8-1 et seq.
2.2 Use of Information
2.2.1. Information is collected to process orders, improve the user experience on the site, and operate the customer loyalty program (if one exists).
2.2.2. The Restaurant may use order details to offer personalized promotions, subject to the customer's consent.
2.2.3. 🔶 Marketing messages will only be sent with the customer's consent, in accordance with applicable federal law:

Text/SMS marketing: governed by the Telephone Consumer Protection Act (TCPA). The Restaurant will obtain the customer's prior express written consent before sending marketing text messages, will clearly state that consent is not a condition of purchase, and will honor opt-out requests (e.g., replying "STOP") immediately.

Email marketing: governed by the CAN-SPAM Act, which permits commercial email on an opt-out basis provided the Restaurant clearly identifies the message as an advertisement, includes a valid physical address, and provides a working unsubscribe mechanism that is honored promptly. As a best practice, the Restaurant will still seek the customer's affirmative opt-in where practical.
2.2.4. Information may be used for oversight, fraud prevention, and maintaining the security of the service.
2.3 Sharing Information with Third Parties
2.3.1. To fulfill an order, customer details (name, phone number, address) will be shared with the Restaurant's staff, suppliers, and the delivery company.
2.3.2. Where external service providers are used (payment processors, email marketing platforms, cloud storage), sharing will be done in accordance with applicable law and subject to a commitment to protect the confidentiality of the information.
2.3.3. The Restaurant does not transfer personal information to third parties for commercial purposes unrelated to the order without the customer's express consent.
2.4 Tracking Tools and Cookies
2.4.1. The site uses cookies to operate properly, remember user preferences, and improve the user experience.
2.4.2. In addition, the site uses analytics tools (such as Google Analytics) and advertising tools (such as the Meta/Facebook Pixel) for statistical analysis and to display personalized ads.
2.4.3. Users may configure their web browser to block the use of cookies, although this may affect the site's functionality.
2.4.4. If the New Jersey Data Privacy Act applies to the Restaurant (see Section 2.6 below), the site will also recognize opt-out preference signals such as the Global Privacy Control (GPC) for New Jersey residents.

Information related to orders is retained for the period required to fulfill the order and issue receipts/invoices, consistent with applicable IRS and New Jersey business recordkeeping requirements. Confirm the specific retention period with your accountant — the source document used a 7-year default under Israeli tax rules, and the appropriate U.S. period should be set based on your accountant's or attorney's advice rather than assumed to match.
2.5.2. Information collected for marketing purposes will be deleted within 12 months of the customer's request for removal, or at the latest upon expiration of the applicable retention period.
2.5.3. Sensitive information (such as allergy or dietary requests) will not be retained beyond the date the order is actually completed.
2.6 User/Consumer Rights 🔶

2.7 Information Security
2.7.1. The Restaurant employs reasonable and commercially accepted security measures to protect personal information, including the use of the SSL/TLS protocol, access permission management, and internal controls.
2.7.2. Despite these measures, no security is absolute, and use of the site is at the user's own risk.

4. Limitation of Liability 🔶
4.1. The Restaurant and/or its representatives bear no liability regarding the consumption of products offered on the site, including any reactions caused by sensitivity to food ingredients, improper storage of food, or consumption of food after a date inconsistent with the nature of the product.
4.2. Consumption of products offered on the site is entirely at the customer's own risk. In all cases, the Restaurant's liability is limited to the amount paid for the product in question.
4.3. The Restaurant is not responsible for damages resulting from use of the site, including information provided, inability to use the site, or damages caused by events outside its reasonable control.
4.4. The Restaurant does not guarantee that there will be no data security incidents, including unauthorized access by third parties, technical errors, or any factor outside its reasonable control. Use of the site is at the customer's own risk.
5. Use of the Site and Its Content
5.1. The Restaurant will make efforts to keep the site running properly but is not responsible for technical disruptions or malfunctions.
5.2. Any use of the site for fraud or harm will result in immediate blocking and may lead to legal action.
